Although the two terms are often confused, possession is not the same as ownership. No legal rule
states that "possession is nine-tenths of the law," but this phrase is often used to suggest that someone
who possesses an object is most likely its owner. However, the owner of an object may not always
possess the object.
To transfer a house deed to a family member right now, obtain a quit form deed. Get the required form
from the recorder or register of deeds in the county where your house is located, then fill it out, sign it in
front of a notary, and send it to your family member.
Land or property must be registered for the first time if it's unregistered when you take ownership of it or
mortgage it. Even if you do not have to register, registering voluntarily: gives you a proof of ownership.
A partition action is a type of lawsuit pertaining to joint owners of real property. When two or more owners cannot agree on the disposition of the property in question, any of the owners can file a partition action in the appropriate court.
